1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Order Some Grub website, mobile applications, and related services (collectively, the "Service"), operated by Order Some Grub ("we," "us," or "our"). By creating an account, placing an order, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and place orders.

2. Description of Service

Order Some Grub is a local marketplace platform that connects customers with independent restaurants, convenience stores, and delivery drivers in Salem County, NJ and surrounding areas. OSG facilitates the placing of orders, processing of payments, and coordination of delivery. OSG does not itself prepare, sell, or deliver food or merchandise — restaurants and stores are independent businesses, and drivers are independent contractors or third-party providers, each responsible for their own products, service quality, and compliance with applicable law.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate, current information, including a valid payment method and delivery address.
• OSG may suspend or terminate accounts for violation of these Terms, fraud, abuse, chargebacks, or suspected illegal activity.

4. Orders, Pricing, and Fees

• All orders are subject to acceptance and availability at the restaurant or store. Menu items, prices, and availability are set by the individual merchant and may change without notice.
• OSG charges a per-order platform fee and a delivery fee, and applies a commission to participating merchants; the total charge (subtotal, fees, applicable tax, and any tip) will be shown before you confirm your order.
• Payments are processed through our third-party payment processor (Stripe). By placing an order, you authorize OSG to charge your selected payment method for the full order amount.
• All prices are in U.S. dollars. OSG is not responsible for currency conversion charges.

5. Payments and Billing

We use Stripe to process all payments. By providing your payment information, you authorize us to charge your card for the amount displayed at checkout, including subtotal, delivery fee, applicable taxes, and any gratuity you choose to add. Failed charges may result in order cancellation. Your payment information is handled by Stripe in accordance with their privacy policy and PCI-DSS compliance standards; we do not store full card numbers.

Group Orders & Split Pay

When using Group Order or Split Pay features, each participant is charged only for their share of the order. All participants must complete payment before the order is transmitted to the restaurant. OSG is not responsible for unpaid shares by other participants in your group.

6. Cancellations and Refunds

• Before preparation: Orders may be cancelled for a full refund before the restaurant begins preparation (typically within 2 minutes of placement).
• During preparation: Once the restaurant has accepted and begun preparing your order, cancellations may not be available or may incur a partial charge.
• Incorrect or missing items: Contact us within 24 hours of delivery. We will issue a credit or refund at our discretion based on the circumstances and documentation provided.
• Delivery issues: If your order is not delivered and the driver has marked it delivered, contact support immediately. We will investigate and, where appropriate, issue a refund.

7. Restaurant Responsibilities

Participating restaurants are solely responsible for the preparation, quality, accuracy, and food-safety compliance of their menu items. OSG does not inspect or certify restaurant kitchens, ingredients, or practices. Restaurants must maintain all required food-service permits and comply with applicable health codes. OSG may remove restaurants from the platform for violations of quality, legal, or operational standards.

8. Delivery

Delivery estimates are approximate and not guaranteed. OSG and its drivers are not liable for delays caused by traffic, weather, address errors provided by customers, or other circumstances beyond our reasonable control. You are responsible for providing a complete, accurate delivery address and ensuring someone is available to receive your order.

9. Prohibited Conduct

You agree not to use the Service to:

• Provide false information, impersonate others, or create fraudulent accounts;
• Manipulate ratings, reviews, or promotional codes;
• Harass, threaten, or abuse restaurant staff, drivers, or other users;
• Use automated systems, bots, or scripts to access the Service without our written consent;
• Violate any applicable law or regulation.

10. Intellectual Property

All content on the OSG platform — including logos, design, text, software, and data — is owned by or licensed to OSG and is protected by applicable intellectual property law. You may not copy, modify, distribute, or create derivative works from our content without express written permission.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. OSG DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. OSG MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, OR FITNESS OF MENU ITEMS, RESTAURANT OPERATIONS, OR DELIVERY SERVICES.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OSG'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO OSG IN THE SIX (6) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL OSG BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

13. Dispute Resolution

Please contact us at support@ordersomegrub.com first to resolve any dispute informally. We will make a good-faith effort to resolve concerns within 10 business days. For unresolved disputes, you and OSG agree to submit to binding arbitration in Salem County, NJ under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property matters. You waive the right to participate in class-action lawsuits against OSG.

14. Governing Law

These Terms are governed by the laws of the State of New Jersey without regard to conflict-of-law principles. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Salem County, New Jersey.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform. Continued use of the Service after the effective date of an update constitutes acceptance of the revised Terms.
